1. Scope and operator
PodMagi is a business name used for an AI-assisted video-editing service operated from Québec, Canada, including reference-style analysis, captions, reframing and export. These terms apply to the website and to the services ordered from PodMagi. The Legal Notice gives the operator’s details.
PodMagi — 80 Rue des Sept Sommets, La Conception, QC J0T 1M0, Canada. Email: support@podmagi.com. Telephone: +1 (514) 838-2128.
2. Accounts and service access
Provide accurate account information and protect your credentials. You must be at least 18 years old and able to enter into a contract; a person acting for an organization must be authorized to do so. Report suspected unauthorized access promptly.
Features, processing allowances and supported export formats depend on the selected plan. AI output requires human review and does not guarantee audience growth, accuracy or exclusive intellectual property rights.
3. Plans, prices and payment
Published prices are in US dollars (USD). Monthly prices are Free $0, Creator $29 and Agency $79. Annual prices are Free $0, Creator $290 and Agency $790, billed for the year. Annual paid plans cost the equivalent of ten monthly payments. Prices do not include applicable sales taxes (GST/HST and QST), which are added where required and shown before you confirm an order. Monthly processing allowances do not roll over.
Before a paid order, the order summary states the merchant’s name and address, a description of the service, the total price payable in USD including any mandatory fees, applicable taxes, the billing period, renewal conditions and material service limitations. Do not complete a purchase if these details are missing. A paid contract begins only after an order is accepted and confirmed, and we then email you a copy of the contract that you can save and print.
4. Renewal and cancellation
If you choose a renewing subscription, renewal occurs at the disclosed interval until cancellation. You may cancel at any time by emailing support@podmagi.com or, where offered, through your account settings. Cancellation takes effect at the end of the paid period, without another renewal, and we confirm receipt and the effective date.
For consumers in Québec, a paid plan with an initial term of more than 60 days renews automatically only on an open-ended basis, and any renewal notice required by law is sent in writing before the renewal date. Plan changes normally apply from the next billing period unless you expressly agree otherwise. Statutory refunds, cancellation rights and remedies take priority over these rules.
5. Cancellation rights for consumers
Québec’s Consumer Protection Act gives consumers specific rights for contracts concluded at a distance. If the required information was not presented clearly and prominently before the contract, or if the copy of the contract you received lacks required information or cannot easily be saved and printed, you may cancel the contract by notice within 7 days after receiving the copy. If you do not receive a copy within 15 days after the contract was concluded, you may cancel it within 30 days after it was concluded. We refund all amounts paid within 15 days of your notice.
Send your notice by email to support@podmagi.com or by post to our address above. No special form is required; the Office de la protection du consommateur publishes sample letters at opc.gouv.qc.ca. Consumers in other provinces and territories may also have rights under their local consumer-protection laws.
Creating an account or accepting these terms alone does not waive any statutory right. You can close a free account at any time by emailing us.
6. Your content and AI outputs
You retain your existing rights in uploaded material. You grant the limited rights needed to process it on your instructions and deliver the service. You must hold the necessary rights in footage, reference videos, music, fonts, voices and likenesses.
An editing style is not permission to reuse protected material or impersonate someone. Output may contain errors or resemble other works. Review it before publication. Customer-specific style training, where ordered, follows your instructions; use of customer media to train shared or general-purpose models requires separate, explicit opt-in.
7. Consumer guarantees and liability
Mandatory Québec and Canadian consumer protections apply, including the legal warranties that a service be of the quality reasonably expected and fit for its normal use, and the rules on contracts concluded at a distance. Contact us for correction or other statutory remedies, which can include a price reduction or termination where the legal conditions are met.
No provision excludes liability that cannot legally be excluded, removes your privacy rights or imposes a blanket non-refundable policy. Liability is assessed under applicable law. We do not promise uninterrupted service or a particular social-media result.
8. Misuse, suspension and changes
The Acceptable Use Policy applies. We may restrict access where reasonably necessary to address unlawful activity, a material breach or security risk, with reasons and an opportunity to respond where appropriate. Urgent restrictions may be necessary to protect people or data.
Material contractual changes will be communicated before taking effect. Changes do not retrospectively remove accrued rights. For paid consumer services, statutory conditions on modifications and termination remain applicable.
9. Personal information
The Privacy Policy explains how we handle personal information for accounts, inquiries and business administration under Québec’s Law 25 and Canadian federal law. The Data Processing Agreement applies where PodMagi processes personal information in customer media on the customer’s behalf. The AI Policy and Cookie Policy provide additional detail.
10. Governing law and complaints
These terms are governed by the laws of the Province of Québec and the federal laws of Canada that apply there. This choice does not deprive a consumer of the mandatory protections of Québec’s Consumer Protection Act or of the consumer’s home province, including the right to bring proceedings where the consumer lives. For business customers, the courts of Québec have jurisdiction unless the law requires otherwise. No arbitration clause or foreign forum is imposed on consumers.
Send complaints to support@podmagi.com first and we will reply in writing. Consumers may also contact the Office de la protection du consommateur (opc.gouv.qc.ca). This does not restrict access to the courts.
11. Language
This website and these terms are currently provided in English. If you are a consumer in Québec, you are entitled to receive a French version of these terms before you agree to be bound by the English version. Request it at support@podmagi.com; we provide it before any paid order is concluded, and you may then choose to be bound by the English version if that is your express wish.
Version française : les consommateurs du Québec peuvent obtenir une version française des présentes conditions en écrivant à support@podmagi.com avant toute commande payante.
